Surrogate Mother: Legal Advice for Surrogacy Agreements.
Technology and science has afforded us with many possibilities that were once thought impossible. One such phenomenon is the surrogacy process. With the help of modern science couples who are unable to conceive children of their own the conventional manner can now look forward to parenthood. This is a very complex undertaking however and seeking legal advice for the surrogate mother and commissioning parents are of the utmost importance.
As of the 1st of April 2010 the legislation of South Africa has moved to include the surrogacy agreement/arrangement to minimise the legal uncertainty amongst intended parents. The commissioning couple and surrogate mother will require legal advice and assistance as a written surrogate agreement needs to be filed and confirmed by the High Court before the in-vitro fertilisation process can begin. The agreement has to be signed by all parties involved, namely the commissioning parents and surrogate mother. Where a surrogate mother is married or involved in a permanent relationship the court will require a written consent by the husband or partner and he/she has become a party of the agreement.
